Two 'Abstract' copies of Estate Settlement Agreement

(Abstract 1):-
Mary Flack - William Flack, agreement. 17 Oct 1793, Mary Flack, Admr. of estate of John Flack dec'd. and guardian for her own children and William Flack guardian for the 4 eldest children of said John Flack, agreed on land on which the 4 children are now living shall remain in possession of sd. children until heirs of John Flack come to full age. All that part of the land claimed by John Flack that lies on waters of Cathies Creek, the widow's dower excepted, shall be wholly under direction of said children. Also a tract of land lying on Mountain Creek shall be for use of younger children of sd. Flack and born of her the sd. Mary, without hindrance.

(Abstract 2):-
State of NC, Rutherford County: 3 Apr 1797, July Ct. 1797. The commissioners appointed by said county to divide lands belonging to estate of John Flack, dec'd. between the legatees and claimants of sd. estate do give unto Andrew and George Black (Flack), eldest sons of dec'd., all that tract of land and plantation on Cathys Creek whereon dec'd. last lived, containing 380 a valued by us at 585 pds. to be possessed of them in common and not as joint tenants. We also give unto John and William Flack, sons of sd. dec'd. tract of land cont. 200 a lying in the "Ricely Fork" of Mountain Creek, valued at 150 pds. divided as follows: All land in sd. tract on NW side of Reedy Fork up so high as Second Broad above the improvement and said Second Branch be dividing line to the head - then to line and the land in the N, NW of sd. branches shall be division of one portion of all land of the other portion sd. legatees either of them shall have choice of divisions by paying such portion to the other who is willing to give choice so as to make division equal value.

We at the request of widow of sd. dec'd. and the legatees have valued the dower at 71 pds. 5 shill. and then deducted value of dower out of first portion of land. We find a balance of 31 pds. 17 shill. and P. is due from Andrew and George Flack to John and William Flack to make allotment equal, to be pd. when allowed by law.
