SETTLING OF ESTATE OF GEORGE FLACK (d.22 Sep 1819)

GREETINGS TO ALL WHOM THIS MAY CONCERN.

That whereas - George Flack of BracyLagh parish of Loughgilly and County of Armargh died on the twenty second day of September, Eighteen Hundred and Nineteen. And whereas the said George Flack, dying intestate he then leaving his wife Agnes Flack, otherwise Gracey, and seven sons, and two daughters, his said wife and old son John Flack the both agreed to leave the whole of their fathers settlement to the deceased's two brothers to wit Hugh Flack and of Tullin and William Flack of Braghagh and Robert Brown of Killekeven, all of the County of Armargh. The said 3 men, to wit, Hugh Flack and William Flack and Robert Brown hearing the words expressed by the deceased, George Flack, that all of his two freeholds should be divided between his seven sons, share and share alike them and each of them paying such a certain dowery of maintenance to their mother as shall hereafter be set forth during her life or widowhood and such a certain sum of money for the deceased's two daughters as shall be hereafter set forth, and also paying all the debts now standing against the said property or chattels together with the funeral expenses. The award now made by us three men named above is as follows.

That the whole family shall live together until the little children come to maturity, and if in case they cannot agree to live on together they are to give their mother three hundred of good oatmeal year and yearly together together with one barrel of "Praties" selting with sufficient dung for same, and a small peck of flax seed sowing year and yearly during her life and or widowhood, together with twenty pounds Sterling to Agnes Flack his daughter and twenty pounds Sterling to his daughter Sarah Flack where they arrive at the age of seventeen years old. We also award that the old woman the widow shall get the parlour for her dwelling house. If in case they cannot agree to live together during her life or widowhood and to be kept in sufficient order and repair for her. And further we award that the deceased's son John Flack gets the remainder of the dwelling house, that is the kitchen and other rooms, where the rest of the children are reared.. And further the parlour at the death of the old woman it shall be in the power of Hugh Flack or William Flack to give the parlour to any other son they see most deserving..

Now I Agnes Flack otherwise Gracey widow and relic of George Flack deceased, and John Flack the old son of deceased, both of the parish of Loughgilly and County of Armagh, do bind ourselves and each of ourselves in the penal sum of two hundred and fifty pounds Sterling to stand to the above family settlement made by the above Hugh Flack, William Flack and Robert Brown or otherwise in failure of either of us coming short of said settlement that is Agnes Flack otherwise Gracey and his son John Flack the said penalty of two hundred and fifty pounds Sterling to stand in full force and value in law, in as full manner as if the said two had borrowed the sum of two hundred and fifty pounds Sterling from the said Hugh Flack and William Flack and Robert Brown., and places their bonds on this stamped paper for the same recoverable in law.

I, Agnes Flack wife of the deceased and John Flack son of the deceased agree to the above family settlement made by the within named Hugh Flack and William Flack and Robert Brown - In witness we have set out hands this 25th day of September Eighteen Hundred and Nineteen - 1819.

Before signing if in case any of the young sons be refractory and not agreeable it shall be in the power of Hugh Flack or William Flack to put them out to the stranger. Before signing if any of the sons dies under age of twenty one years, or not having a lawful child his part to be equally divided between the surviving son or sons equally.

And if in case any of the two daughters dies before they come of age or not leaving a lawful issue the surviving daughter to get her part.
